ID DORONG PENGUATAN PERAN LEMBAGA ADAT DALAM MENEGAKKAN OTORITAS HUKUM ADAT DAN KEDAULATAN ATAS HAK WILAYAH ADAT DI SETIAP KOMUNITAS DAYAK DI KALIMANTAN

Bertempat di Gedung Pancasila, Sintang, pada tanggal 29 November 2018, Institut Dayakologi, melalui Direktur Eksekutifnya, Krissusandi Gunui’ memenuhi undangan penyelenggara Konferensi Temenggung Internasional  bekerjasama dengan Pemda Sintang sebagai salah satu narasumber. Pada kesempatan tersebut ID diminta menyampaikan materi “Peran Generasi Muda Dayak dalam  melanjutkan dan mewariskan hukum adat sebagai jati diri Dayak, menjaga, memelihara, menghormati, mengamalkan dan menegakkan nilai-nilai Kebudayaan Dayak sebagai satu kebanggaan dan sebagai satu ciri/identitas di era millenial era world citizen  sekarang dan nanti”. Penyelenggara juga meminta kepada ID untuk menekankan hubungan antara hutan/wilayah adat dengan kebudayaan Dayak beserta hukum adatnya kepada kaum muda.

Untuk itu, Kriss Gunui’ yang mewakili ID menyampaikan materi sesuai permintaan peneyelenggara dengan menitikberatkan uregensi pewarisan atau regenerasi budaya pada kaum muda melalui pendidikan budaya dan penguatan sanggar-sanggar budaya di komunitas. ID juga menggarisbawahi bahwa keberadaan wilayah dan hutan adat sebagai salah satu sumber identitas budaya Dayak yang membentuk karakter dan nilai-nilai kebudayaan itu sendiri. Untuk itu, menjaga dan mempertahankan serta mengelola dan memelihara wilayah adat sesuai kearifan lokal menjadi kewajiban seluruh generasi Dayak. Waktu sangat terbatas, panitia hanya menyediakan waktu kurang dari 60 menit yang saat itu plenary  tandem dengan Ambrose Atama Katama (Head of Youth Council of BDF), narasumber dari  Dayak Dusun, Sabah, Malaysia. Setelah menanggapi beberapa pertanyaan dan respon dari peserta, Tim ID langsung kembali menuju Pontianak, malam itu juga.

Mengenai hasil dalam bentuk kesepakatan dan keputusan konferensi, sepenuhnya ada di pihak penyelenggara. Institut Dayakologi tidak terlibat atau berpartisipasi dalam diskusi-diskusi maupun proses perumusan keputusan-keputusan konferensi tersebut. Untuk itu, ID menegaskan secara kelembagaan dan personal pimpinan bahwa ID tidak ada andil, mendukung atau berpartisipasi dalam segala keputusan yang dibuat penyelenggara karena kehadiran ID hanya sebatas sebagai narasumber. ID berharap konferensi tersebut memberi manfaat kepada komunitas khususnya perwakilan lembaga adat yang hadir dalam memperkuat hukum dan lembaga adat dalam menegakkan otoritas hukum adat dan kedaulatan atas hak wilayah adat di komunitasnya masing-masing dan bukan sebaliknya.

ID CALLS FOR STRENGTHENING ROLE OF CUSTOMARY INSTITUTION IN UPHOLDING CUSTOMARY LAW AUTHORITY AND SOVEREIGNTY OVER THE RIGHT OF ANCESTRAL LANDS IN EACH OF DAYAK COMMUNITIES IN KALIMANTAN

Taking place at the Gedung Pancasila in Sintang on November 29^th, 2018, Institut Dayakologi, represented by its Executive Director - Krissusandi Gunui’ attended the invitation to the International Temenggung Conference organized in collaboration with the Regional Administration of Sintang District as one of the resource people. In this conference, ID was requested to address the topic of “The Role of Dayak Younger Generation in continuing and inheriting customary law as the self-identity of Dayak, in safeguarding, maintaining, honoring, implementing and upholding the values of Dayak Culture as one pride and as one identity in the millenial era of the world citizen now and later”. The organizer of the conference also requested ID to highlight the link between customary forest/lands and Dayak culture as well as its customary law to the youth.

To that end, Krissusandi Gunui’, who represented ID, delivered material in line with what had been requested by the organizer by highlighting the importance of the transfer or re-generation of culture to the youth through cultural education and cultural galleries in the communities. ID also highlighted that the existence of customary lands and forests as one of the sources of identity of Dayak culture forges the character and values of the culture itself. Therefore, safeguarding and defending as well as managing and maintaining customary lands based on traditional knowledge becomes mandatory for entire Dayak generation. Time was limited, the organizer provided only less than 60 minutes and at the same time it was dual plenary with Ambrose Atama Katama (Head of Youth Council of BDF) – resource person from  Dayak Dusun - Sabah, Malaysia. Following responding a few questions of the participants, ID team returned to Pontianak at the night.

With regard to the output resulted from the conference that was in the form of consensus and decision of the conference, it was fully up to the organizer.Institut Dayakologi was not involved nor participated in any discussions or in the processess of formulating such conference’s decisions. Therefore, ID confirms that both institutionally and personally, ID did not take part, support or participate in any of the decision making by the organizer as ID’s presence was merely as resource person. ID hopes that the conference will be beneficial to communities, particularly the representatives of customary institutions present in strengthening customry law and institutions in upholding the authority of customary law as well as sovereignty over the right of ancestral lands in respective communities and not the other way around.
